Inquiries and Investigations into Marine Casualties – Cayman Islands
Part XVII of the Merchant Shipping Law deals with Preliminary Inquiries, Formal Investigations and Appeals. The requirements for such procedures stem from the SOLAS Convention and the provisions are modelled along the lines of the corresponding provisions in the UK Merchant Shipping Act 1995. They also reflect existing Cayman Islands law on the subject.
Check current shipping notices for duties and obligations to report marine casualties.
Legal Proceedings are set out in Part XVIII of the Law. This is partly based on the corresponding provisions in the UK Merchant Shipping Act, 1995, and on other recent United Kingdom legislation. Sections 439(9), (10) and (11) reflect certain requirements contained in UNCLOS.
